1. Acceptance of Terms
By using the vending machine (“the Machine”) operated by Davis Vending Company (“the Company”), you agree to comply with and be bound by these Terms and Conditions. If you do not agree with any part of these terms, please do not use the Machine.
2. Vending Machine Usage
2.1. The Machine is provided for the sale of snacks and miscellaneous items (“Products”) in California.
2.2. You must use the Machine in accordance with all applicable laws and regulations.
3. Product Consumption and Proposition 65 Warning
3.1. You acknowledge that the Products sold by the Machine may contain ingredients or substances that are known to the State of California to cause cancer, birth defects, or other reproductive harm. These substances may be present in trace amounts as part of the natural composition of certain food products.
3.2. It is your responsibility to be aware of and consider Proposition 65 warnings when purchasing and consuming Products from the Machine.
3.3. The Company provides this warning in compliance with California’s Proposition 65 requirements, and it does not imply that the Products are unsafe when consumed in accordance with their intended use.

4. Health and Safety
4.1. Please exercise caution while using the Machine. Ensure your safety and the safety of others while accessing the Machine.
4.2. The Company is not liable for any injuries, accidents, or damages that occur while using the Machine.
5. Machine Malfunctions
5.1. If you encounter any issues with the Machine, please contact the Company immediately to report the problem.
5.2. The Company will make reasonable efforts to address and resolve any malfunction in a timely manner but is not responsible for any losses or inconveniences caused by Machine malfunctions.
6. Liability
6.1. To the fullest extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Machine or consumption of Products.
6.2. The Company’s liability, if any, shall not exceed the total amount paid by you for the Products in question.
7. Indemnification
You agree to indemnify and hold harmless Davis Vending Company and its officers, employees, and agents from any claims, liabilities, damages, expenses, or losses arising out of your use of the Machine or any violation of these Terms and Conditions.
8. Termination
The Company reserves the right to terminate or suspend your access to the Machine at its discretion, without notice, for any violation of these Terms and Conditions or for any other reason.
